This Privacy Policy explains how ARBIGAIN("we", "us") collects, uses, shares, and protects information when you use our Services. Our Services are designed for businesses; however, some limited personal information is processed. Capitalized terms not defined here have the meanings given in our Terms & Conditions.

1. Overview & Scope

We operate the ARBIGAIN platform, analytics, information, applications, websites, and other products and services (the “Services”). Our Services are designed for businesses and are not intended for personal, family, or household use. We treat personal information processed via our Services as pertaining to individuals acting as business representatives. This Policy covers what we collect, how we collect it, how we use it, how and when we share it, your rights and choices, and how to contact us.

2. Information We Collect

Personal Information

“Personal Information” means information that directly or indirectly identifies a person (in some cases, device information may be personal information). We may collect:

  • Identifiers and contact details (e.g., name, business postal address, email, phone).
  • Device and network identifiers (e.g., IP address, device IDs, cookies, and similar identifiers).
  • Third‑Party Account information you choose to connect for integrations and analytics (e.g., marketplace or advertising accounts).

Examples include information needed to establish an account, authenticate, process payments, and link Third‑Party Platforms; information to contact you and provide Service results, support, and product updates; and aggregated, de‑identified information for user experience maintenance.

Usage Data

“Usage Data” is collected automatically when you interact with the Services and may include IP address, mobile identifiers, browser type, ISP, operating system, pages viewed and frequency, referral/exit pages, clickstream, and timestamps. We collect this via cookies, web beacons, SDKs, and similar technologies.

Customer Data

With your authorization (e.g., when you connect Third‑Party Platforms), we may process data about your customers (“Customer Data”) to provide the Services. Treatment of Customer Data is governed by the “Your Customer Data” section in our Terms & Conditions. You represent that you collected Customer Data in accordance with your privacy policy and applicable laws and that you have the right to provide it to us.

3. How & When We Collect

We collect Personal Information that you provide directly, such as when you register, subscribe, purchase, contact support, participate in promotions, or connect Third‑Party Platforms. We may also receive information from service providers, partners, data brokers, and publicly available sources (e.g., professional profiles).

We use cookies and similar technologies to maintain sessions, measure interactions (including with our emails), and improve the experience. “Do Not Track” signals are not honored due to inconsistent industry standards at this time.

4. How We Use Information

  • Provide, operate, maintain, and improve the Services.
  • Authenticate users, process payments, and deliver requested features.
  • Communicate about Service updates, security notices, and administrative messages.
  • Send product news and marketing (you can opt out at any time).
  • Conduct analytics, reporting, optimization, and research (often using aggregated/de‑identified data).
  • Protect against fraud, abuse, and security risks; comply with legal obligations.

5. How & When We Share

General Policy

We may share Personal Information as described below. We may share Usage Data without restriction (e.g., in aggregated or de‑identified form).

Affiliated Entities

We may share with our subsidiaries and affiliates for the purposes described in this Policy.

Service Providers

Trusted providers may access information as reasonably necessary to provide services such as hosting, infrastructure, security, payments, analytics, product development, and support—subject to confidentiality and appropriate safeguards.

Business Transfers

We may transfer information in connection with a merger, acquisition, financing, reorganization, insolvency, or sale of assets.

Legal, Safety, and Protection

We may disclose information to comply with law, legal process, and lawful requests; to enforce our agreements; and to protect rights, property, safety, and the integrity of our Services.

We may process and store information in Türkiye and other countries. Where required, we use appropriate transfer mechanisms and safeguards.

6. Cookies & Targeted Advertising

We and our partners may use cookies, pixels, SDKs, and similar technologies to measure site traffic, understand usage, and provide advertisements (including interest‑based ads) on our Services and across the Internet. Advertisers/ad networks may collect device identifiers, IP address, browser, actions related to ads, clicked links, and conversions. We do not share your Personal Information with them for their independent marketing.

We adhere to the Digital Advertising Alliance Self‑Regulatory Principles.

7. Your Choices & Rights

Depending on your jurisdiction, you may have rights to access, correct, update, object to, restrict, or delete Personal Information; to data portability; and to withdraw consent (where processing is based on consent). To exercise rights, contact us as described in Contact & Controller. We may request additional information to verify your identity. We may retain certain information for recordkeeping, security, or legal obligations and may keep de‑identified data.

You may opt out of marketing communications at any time via the unsubscribe link or by emailing privacy@arbigain.com.

8. EEA/UK & International Transfers

For residents of the EEA, Switzerland, and the UK, ARBIGAIN acts as a data controller for Personal Information collected via the Services. We process Personal Information under lawful bases including: performance of a contract (to provide the Services), legitimate interests (e.g., to secure and improve the Services, prevent fraud), compliance with legal obligations, and consent (where applicable).

Data subject rights under GDPR include: access, rectification, erasure, restriction, objection, and data portability. You may lodge a complaint with your local supervisory authority. International transfers are supported by appropriate safeguards (e.g., standard contractual clauses) where required.

9. California Privacy (CCPA/CPRA)

California residents may have rights to know/access specific pieces or categories of Personal Information, to delete Personal Information, to correct Personal Information, to opt out of certain sharing/“sale” (as defined by law), and to limit the use/disclosure of sensitive Personal Information. We do not sell Personal Information as the term is commonly understood. We respond to verifiable consumer requests within statutory timeframes. To submit a request, see Contact & Controller. We will verify requests using information associated with your account or as otherwise permitted by law. We do not provide Social Security numbers, financial account numbers, or account passwords in response to access requests.

10. Children’s Privacy

Our Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If you believe a child has provided Personal Information, contact us (see Contact & Controller) and we will delete it promptly.

11. Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information. No security measures are perfect, and transmission over the Internet involves inherent risks.

12. Data Retention

We retain Personal Information as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. We may retain de‑identified or aggregated data for longer.

13. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will provide notice (e.g., by email or in‑product notification) and indicate the “Last updated” date. Your continued use of the Services after the effective date signifies acceptance.
